Is there a minimum contract length?

No, not at all. We are happy to work on short term or longer-term assignments.

How much does it cost to take on a contractor?

Market rates will tend to fluctuate depending on demand. We will always be happy to provide you with an overview of market rates nationally or run a more localised benchmarking exercise if required.

Does it cost a Contractor (temporary worker) anything to use an agency?

No, it doesn't.

 What is IR35?

IR35 was first introduced with the intention to clamp down on 'disguised employment after a significant rise in the number of contractors setting up their own Ltd companies.

The rules of IR35 The 'off payroll working rules' are to determine whether a Contractors (off payroll workers) is genuinely in business of their own account or if they are in fact a hidden employee avoiding tax.

'Inside'/'outside' - what does it mean?

Inside IR35-off payroll working rules apply-tax / Ni should be deducted.

Outside IR35-Off payroll rules do not apply-the contractor is able to work through their Ltd company.

How is IR35 assessed?

There are multiple areas to which as assessment is undertaken, however the 3 key areas are:

  • Right of substitution (the right to provide a substitute)
  • Supervision, direction, and control (over how the contract/work is delivered)
  • Mutuality of obligation (is the Contractor/Client obligated to provide future workload).

What is an SDS?

An SDS (Status Determination Statement) is certification of the tax status of a contract.

Which clients are exempt from IR35?

'Small companies' within the private sector.

A small company is one which meets two or more of the following criteria:

  • Annual turnover of not more than $10.2 million
  • Balance sheet total of not more than $5.1 million
  • No more than 50 employees.

If this applies, we will require you to complete our exempt company’s declaration form.

Working as a Contractor to a 'small business' in the private sector

No need to have an assessment completed by the client. You will still need to complete your own assessment on the assignment to ensure it is suitable for a Limited company contractor.

Do you vet your Umbrella companies?

Yes, we do. We have a vigorous vetting processes and preferred supplier list of Umbrella companies, all of which are tax compliant and FCSA accredited.

What is a Key Information Document (KID)?

Contractors working inside IR35' under the Off-Payroll rules should expect to receive a KID.

What should be included in a KID?

Contract rate, payment intervals, statuary and non-statuary deductions, holiday entitlement, fees or goods charged to the worker.

What is the Construction Industry Scheme (CIS)?

Is a HMRC scheme which applies if you work for a contractor in the construction industry but not as an employee.
